The employment contract is an agreement between the employee and the employer, which regulates the employment relationship and contains the rights and obligations of the parties. In the employment contract, the employee undertakes to provide his or her work or service for a fixed or indefinite period of time within the organization and orders of another person, called the employer, who undertakes to pay a reward.

  • The employee respects the general and special orders and instructions of the employer.
  • The employee is not obliged to comply with the general and special orders and instructions of the employer, which change the terms of the employment contract. The contract is changed by agreement between the parties. 3) The employee is not obliged to apply the general and special orders and instructions of the employer, which risk his or her life and health.

The employee carries out carefully the work that is being charged. 2) The employee must use, according to the rules, the working tools and equipment that the employer supplies and makes available to him.

The employee gives account to the employer of everything received on behalf of the employer during the exercise of his activity within the contract, in particular for sums of money. 2) The employee immediately returns to the employer everything he has received, with the exception of his own tips and personal gifts. 3) The employee shall immediately return to the employer all the things produced by his activity under the contract.

  1. The employee legally retains the legitimate interests of the employer.
  2. The employee helps within his reach other employees or the employer in case of accident or danger.
  3. During the validity of the contract, the employee must not perform any work paid by third parties, which damages the employer or competes with him.
  4. During the validity of the contract and after its termination, the employee must preserve the facts intended to remain secret as: – the secret of fabrication and activity that he knew when he was serving the employer.
  5. The employee has the right to denounce criminal offenses, violations of the labor legislation or contract for which he is aware in the competent bodies.

GENERAL PROTECTION

  • no employee must use machines without having taken all the necessary protective measures.
  • dangerous parts of the machinery must be equipped with protective equipment.
  • correctly use machinery, equipment, tools, hazardous substances, transport equipment and other means;
  • to correctly use the individual protective equipment made available to them and, after use, to return them to the place where their safe storage is planned;
  • not to discard, alter or displace arbitrarily the safety mechanisms mounted on machinery, equipment, tools, plant and buildings and to properly use these mechanisms;

The employee must:

  1. correctly use machinery, equipment, tools, hazardous substances, transport equipment and other means;
  2. to correctly use the individual protective equipment made available to them and, after use, to return them to the place where their safe storage is planned;
  3. not to discard, alter or displace arbitrarily the safety mechanisms mounted on machinery, equipment, tools, plant and buildings and to properly use these mechanisms;
  4. to immediately notify the employer, the employee in charge of safety and health at work and the representatives of the employees, for any work situation for which they have a reasonable motive to assess as a case presenting a serious risk to safety and health as well as any defects found in the protection system;
  5. e. to cooperate with the employer, the employee in charge of safety and health at work and representatives of the employees;
  6. until the performance of all duties or requirements determined by the laboUr inspector, in order to protect the safety and health of the employees at work;
  7. until it is necessary to allow the employer to ensure that the environment and working conditions are safe and without risk to safety and health within their scope of activity.
